MASIN provides a full spectrum of services to the construction and engineering industry. Our expertise in claims consultancy, independent expert services, quantum and delay analyses, and support services is highly regarded and valued by our clients. Our lead and assistant experts are regularly praised for their attention to detail, client focus, responsiveness, and professionalism.
Whether you are an employer, contractor, sub-contractor, or law firm, MASIN can provide the right individual or team to meet your needs and requirements. Our key services are:

CLAIMS CONSULTANCY
We offer claim management, claim assessment, third-party independent assessment, and dispute avoidance services for engineering, construction, and commercial matters, including:
Preparation of claims, such as extensions of time, time-related costs, variations, and final accounts, on behalf of subcontractors and general contractors for all types of construction contracts and projects.
Review and assessment of claims submitted by subcontractors or general contractors on behalf of employers or engineers.
Involvement of our specialists in the investigation and analysis, preparation of submissions, and presentation of claims to the opposing party, alongside the client’s team, aimed at increasing the chances of dispute avoidance, amicable settlement, avoiding penalties, and achieving successful claims.
Provision of support at various stages of the project, including interim reviews, regular intervals, and final consolidated claims upon project completion.
All reports prepared by MASIN adhere to international standards and follow industry protocols, such as those set by the Society of Construction Law (SCL) and the American Association of Cost Engineers (AACE), in accordance with the respective contract and/or applicable law.

EXPERT SERVICES
We offer expert evaluation, expert advice, expert witness, and expert determination services for engineering, construction, and commercial matters.
We act as an expert appointed by a party, tribunal, or court, preparing expert reports and testifying as an expert witness in disputes involving delay, quantum, and technical matters related to engineering and construction projects, shareholder disputes, and bilateral investment treaty (BIT) matters.
Our experts have testified before tribunals and judges across institutions such as ICC, DIAC, SIAC, LCIA, QICCA, ADCCAC, ad hoc tribunals, DIFC Courts, and the High Courts of England, the USA, and Malaysia.
The process typically involves preparing main expert reports, joint expert reports (with the opposing party’s experts of similar discipline), rebuttal/reply reports, and testifying before a tribunal or judge. It also includes being cross-examined by the opposing party’s counsel and participating in hot-tubbing (witness conferencing with the opposing party’s expert).
Our area of expertise also includes providing technical input to legal teams on pleadings such as statements of claim (SOC), statements of defense (SOD), rejoinders, and replies.

FORENSIC DELAY ANALYSIS AND DISRUPTION ANALYSIS
To support claims for ongoing, completed, and disputed engineering and construction projects, we undertake forensic delay analysis to determine ‘excusable,’ ‘non-excusable,’ ‘compensable,’ and ‘non-compensable’ delays. This includes identifying any ‘mitigation’ and ‘acceleration measures’ implemented by the contractors.
Our experts are experienced in identifying and executing suitable methods for assessing delays using a variety of delay analysis techniques (both prospective and retrospective), including common Critical Path Method (CPM) methodologies such as:
• Impacted As Planned Analysis (IAP)
• Time Impact Analysis (TIA)
• Time Slice Windows Analysis (TSWA)
• As Planned versus As Built Windows Analysis (APAB)
• Retrospective Longest Path Analysis
• Collapsed As Built Analysis
• As-Built But-For Analysis
The delay analysis process executed by our experts typically involves assessing critical and near-critical path activities, identifying the origins and causes of delay, analyzing cause and effect, determining the magnitude of critical and non-critical delays, apportioning/allocating critical delays according to each party’s actions or inactions, and assessing critical delays that are ‘excusable,’ ‘non-excusable,’ ‘compensable (non-concurrent),’ and ‘non-compensable (concurrent)’ based on concurrency analysis.
Our experts are also experienced in estimating and assessing the quantum of various time-related cost claims (commonly known as “Prolongation Claims”), including but not limited to:
• On-Site Overhead Claim
• Head-Office Overhead Claim
• Loss of Profit Claim
• Interest Claims
Additionally, our experts conduct Disruption Analysis and Productivity Loss Analysis using common methodologies such as:
• Baseline Productivity Analysis
• Earned Value Analysis (EVA)
• Measured Mile Analysis

CONTRACTS SUPPORT AND ADMINISTRATION SERVICES
Under our contract support and administration services for ongoing projects, we provide contract management and claim management services, including the preparation and handling of claims, variations, extensions of time, and issues related to project delays. MASIN offers end-to-end services, including making amendments, follow-ups, and updates.
To manage critical and contentious issues such as project planning, programming, scheduling, delays, and cost variations, we also provide professional advisory and consultancy services. These typically include drafting notices and responses to other party notices after a thorough review of contract documents, tender bids, tender risk evaluations, settlement agreements, and contract closure documents.
Additionally, we offer expert advice and consultancy for handling project instructions related to acceleration, mitigation/recovery of delays, project scope issues, de-scoping, partial or complete termination, and contract closure issues.
