Force majeure and disruption: common questions

When does a disruptive event count as force majeure?
Not automatically. The force majeure clause has to cover the specific event, and you still need to prove it actually caused delay to the project's critical path. Causation, not the label, decides entitlement.
Can we claim an extension of time for shipping and logistics delays?
Often yes, where the delay sits on the critical path and notice and records support it. The strength of an extension of time claim depends on contemporaneous programme evidence, not the disruption alone.
Are sanctions-related supply chain delays recoverable?
They can be, but delay and disruption are treated differently. Quantifying productivity loss and tracing causation under the SCL Protocol and AACE guidance is what makes a supply chain disruption claim credible.
Does concurrent delay affect a force majeure claim?
Yes. When a force majeure event overlaps with an employer or contractor risk event, entitlement to time and money can diverge. The Malmaison approach and the contract terms govern the outcome.
What records strengthen a disruption claim?
Contemporaneous programmes, notices, correspondence, procurement and logistics records, and measured-mile data. Records built now are what protect a claim later.
